EPA’s “Air Transport Rule” Stayed by D.C. Circuit

On Dec. 30, 2011, the Court of Appeals for the D.C. Circuit ruled to stay EPA’s new “Cross-State Air Pollution Rule” – a.k.a. “Air Transport Rule” – pending judicial review. The “Air Transport Rule”, which would replace EPA’s 2005 “Clean Air Interstate Rule”, aims to improve air quality by requiring states to reduce power plant emissions that contribute to ozone and/or fine particle pollution in neighboring states.
